INTRODUCTION

Welcome to THE GROVE GROUP HOLDINGS PTY LTD Website (“Website”).
The Products and/or services (“Product”) provided by THE GROVE GROUP HOLDINGS PTY LTD are subject to the following terms and conditions.
Together with our ‘Shipping Policy’, ‘Privacy Policy’, ‘Returns, Refunds and Exchanges Policy’ and ‘Disclaimer’, they form an “Agreement” that governs the relationship and trading terms that THE GROVE GROUP HOLDINGS PTY LTD (ABN 90 602 984 047) has with the user of this Website or parties via normal business activities (“You/Your”). By continuing to do business with THE GROVE GROUP HOLDINGS PTY LTD or by using this Website, You acknowledge, accept and agree to abide by these legally-binding terms and conditions of use.

DEFINITIONS
"THE GROVE GROUP HOLDINGS PTY LTD" means THE GROVE GROUP HOLDINGS PTY LTD (ABN 90 602 984 047).
"Agreement" collectively pertains to the ‘Shipping Policy’, ‘Privacy Policy’, ‘Returns, Refunds and Exchanges Policy’ and ‘Disclaimer’, which apply to the use of the Website and normal business activity. These may be amended from time-to-time, and You will be notified of these changes—should they occur—in the customer care area of the Website.
“Product” means the Product(s) and/or service(s) specified on the Purchase Order—as the Product(s) and/or service(s) You wish to purchase—pursuant to the Agreement.
"Purchase Order" means the order form completed by You in relation to Your purchase of the Product(s) and/or services(s).

“You/Your" means the customer, client, visitor or user of the Website or parties via normal business activities.
“Content” means material such as text, software, images, audio and video including links to that material.

SECTION 1 - PURCHASE

1.1 By completing a Purchase Order, You are making an offer to purchase the Product at the price set out in the Website, subject to any subsequent notification of price by THE GROVE GROUP HOLDINGS PTY LTD to You in accordance with clause: 1.9.

1.2 Payment must be made at the time of submitting the Purchase Order and entering into the Agreement.

1.3 All Purchase Orders placed through the Website are subject to ‘confirmation’ and ‘acceptance’ by THE GROVE GROUP HOLDINGS PTY LTD.

We will email You with ‘confirmation’ of the receipt of Your Purchase Order, ‘Acceptance’ by THE GROVE GROUP HOLDINGS PTY LTD will be upon Your receipt of the email confirming dispatch of the Product in accordance with clause 3.4 and 3.5 of the Processing and Shipping Policy. THE GROVE GROUP HOLDINGS PTY LTD may reject Your Purchase Order, and refund any payment made by You, at any time, prior to Your receipt of the ‘Acceptance’ from THE GROVE GROUP HOLDINGS PTY LTD.

1.4.1 Payment can be made by credit card. THE GROVE GROUP HOLDINGS PTY LTD accepts Visa, Mastercard and American Express. You warrant that You are an authorised user of the credit card used to complete payment in accordance with this clause—and clause: 1.2 of this Agreement.
1.4.2 Payment can also be made using PayPal. You warrant that You are an authorised user of the PayPal account.

1.5 All Website transactions are settled in Australian Dollars (AUD), the final charge to Your credit card is made in Australian Dollars.
If You are ordering from outside Australia, and Your bank account or credit card is held in another currency, Your purchase will be subject to an exchange rate conversion from the AUD purchase price to Your bank account or credit card currency.
THE GROVE GROUP HOLDINGS PTY LTD is unable to provide an exact currency exchange rate as the rate fluctuates from day-to-day with the current exchange rate market.
Some areas of the Website provide an estimated currency conversion figure. Anywhere a currency other than AUD is shown, is for Your reference only, and may differ from the amount that appears on Your credit card statement.
The final conversion rate is determined by Your banking institution or credit provider at the time of processing the payment.
THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible if the amount charged on Your statement differs slightly from the estimates on the Website due to exchange rate conversions.

1.6 Your Banking institution may charge a small currency conversion fee. THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for associated fees and charges You may incur in addition to price outlined on THE GROVE GROUP HOLDINGS PTY LTD Purchase Order for Product purchased from THE GROVE GROUP HOLDINGS PTY LTD.

1.7 Purchase Orders placed outside Australia may be subject to the relevant taxes and duties applicable to the jurisdiction from which the order was placed. THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for the incursion of these taxes and/or duties being charged to You.

1.8.1 GST
GST means the Australian Goods and Services Tax charged under “A New Tax System (Goods and Services Tax) Act 1999 (the “Act”)". Some Products listed on THE GROVE GROUP HOLDINGS PTY LTD Website are subject to Australian GST.

1.8.2 Consumer Purchases and GST
Where GST is applicable, and unless stated to be otherwise, charges referring to the purchase of products provided by THE GROVE GROUP HOLDINGS PTY LTD are GST inclusive.
THE GROVE GROUP HOLDINGS PTY LTD will issue a Purchase Order for all purchases as stated in sections: 1.1 and 1.3 of this Agreement.

1.8.3 Wholesale Accounts and GST
Unless stated to be otherwise, charges referred to for use of any services or purchase of any Product provided by THE GROVE GROUP HOLDINGS PTY LTD are GST exclusive, GST of Products that incur GST will be listed separately. THE GROVE GROUP HOLDINGS PTY LTD will issue a Tax Invoice for all purchases.

1.9 THE GROVE GROUP HOLDINGS PTY LTD may vary prices in the event of price changes or mistakes with reasonable prior notice to You. If THE GROVE GROUP HOLDINGS PTY LTD requests payment for increased prices, You may cancel the order by giving notice to THE GROVE GROUP HOLDINGS PTY LTD, which must be received within seven days of the announcement of the increase.

1.10 Some Products listed on THE GROVE GROUP HOLDINGS PTY LTD Website may not be allowed to enter an international country due to governmental customs and quarantine legislation of that country. THE GROVE GROUP HOLDINGS PTY LTD aims to ensure it is aware of any legislative changes on the importation of food Products to countries outside Australia.
Although, every effort is made to ensure the safe and legal entry of Product to each and every international destination country, THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible in the event that Product is held and detained in the destination country due to legislative changes and/or requirements that are out of the jurisdiction of THE GROVE GROUP HOLDINGS PTY LTD.
It is your responsibility to ensure that there are no importation limitations on Products ordered prior to sending the Purchase Order.
If a Purchase Order is received and THE GROVE GROUP HOLDINGS PTY LTD are aware of the limitations of importation of the destination country, THE GROVE GROUP HOLDINGS PTY LTD will reject the Purchase Order and refund the monies in AUD as outlined on the Purchase Order received.
If a Purchase Order is received and THE GROVE GROUP HOLDINGS PTY LTD are unaware of the limitations of importation of the destination country, and the goods are returned to THE GROVE GROUP HOLDINGS PTY LTD, THE GROVE GROUP HOLDINGS PTY LTD refund the monies in AUD as outlined on the Purchase Order received less charges as outlined in the: Returns and Refunds Policy.

1.11 From time-to-time, THE GROVE GROUP HOLDINGS PTY LTD will offer Products on sale, promotion or discount. Each of these offers will be subject to its own unique terms and conditions. Please ensure that prior to placing a Purchase Order for a Product listed, that You check the Terms and Conditions to ensure that the Product meets Your personal requirements and situation. THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for incorrectly purchased Products under these circumstances. (See section 6 of this Agreement).

SECTION 2 - STOCK

2.1 THE GROVE GROUP HOLDINGS PTY LTD do our best to maintain our "in stock" status on all items. In the event that an item goes on backorder after You have placed Your order, our customer service team will contact You via email or phone.
As per the Refunds and Exchanges Policy, You will be given the option of either:
(a) refunding the backordered item, or
(b) placing the entire order on hold until the backordered Product comes back into stock.
If You do not reply to our email or call, Your entire order will remain on backorder with a ‘hold’ status until the out of stock item comes back into stock, at which point all Product on Your Purchase Order will be processed and shipped.

2.2 Quantity in stock does not take into account the orders which are yet to be processed. It is possible that an order placed earlier will receive the stock allocation which was displayed at the time of Your order. Inventory discrepancy can also affect the accuracy of the stock status displayed on THE GROVE GROUP HOLDINGS PTY LTD Website.

2.3 THE GROVE GROUP HOLDINGS PTY LTD reserves the right to limit the quantity of items purchased with regards to limited edition and/or exclusive Products. The quantity per limited edition items currently stands at ONE unit per customer. It is a condition of this Agreement that You do not resell the Product on to a third party.

2.4 THE GROVE GROUP HOLDINGS PTY LTD complies with the Food Standards Code Australia New-Zealand to ensure our Products are of the highest quality, safety and efficacy for our customers. THE GROVE GROUP HOLDINGS PTY LTD makes every effort to ensure that any third parties handling THE GROVE GROUP HOLDINGS PTY LTD Product, also comply. However, THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for the compliance of these third parties.

SECTION 3 - PRIVACY AND SECURITY

THE GROVE GROUP HOLDINGS PTY LTD is committed to ensuring the privacy of your personal information. The ‘Privacy and Security Policy’ sets out the process we use to manage your personal information in compliance with the Privacy laws.

SECTION 4 - PROCESSING AND SHIPPING

THE GROVE GROUP HOLDINGS PTY LTD makes every effort to ensure that You receive any products and services You order. The ‘Processing and Shipping Policy’ sets out the process we use to manage your orders and meet your expectations.

SECTION 5 - RETURNS, EXCHANGES AND REFUNDS

THE GROVE GROUP HOLDINGS PTY LTD handles returns, exchanges and refunds in accordance with the Australian Consumer Protection legislation—providing a fair and reasonable Returns, Exchanges and Refunds Policy.
Please ensure that you read the ‘Returns, Exchange s and Refunds Policy’ statement thoroughly prior to purchase.

SECTION 6 - USE OF THE WEBSITE

6.1 You agree that You will use this Website in accordance with this Agreement and that You will not use the Website for any unlawful purpose.

6.2 You agree that You will not violate or attempt to violate the security of the Website. You will not hack into the Website, THE GROVE GROUP HOLDINGS PTY LTD’s computer systems or the computer systems of other users of the Website. Hacking means unauthorised access, malicious damage and/or interference; and, includes—without limitation—mail bombing, propagating viruses, worms or other types of malicious programs, deliberate attempts to overload a computer system, broadcasting attacks or any other method designed to damage or interfere with the operation of a computer system or Website.

(g) Download any file posted by any other user of a Communication Facility if You know, or reasonably ought to know, that the file cannot legally be distributed in such manner.

6.5 THE GROVE GROUP HOLDINGS PTY LTD may from time-to-time monitor or review the Contents of the Website Communication Facility. While THE GROVE GROUP HOLDINGS PTY LTD reserves its right to edit, refuse to post or to remove any information and/or materials (in whole or in part) that in THE GROVE GROUP HOLDINGS PTY LTD’s sole discretion is in any way objectionable or in violation of any applicable law or the Agreement.

6.6 THE GROVE GROUP HOLDINGS PTY LTD has no obligation whatsoever to monitor any Communication Facility or to edit, delete or refuse to post such Contents, nor is THE GROVE GROUP HOLDINGS PTY LTD responsible for any Contents in any Communication Facilities (including, but not limited to any information, comments and/or advice of any individual referred to as ‘guest’ or ‘expert’ whose statements and opinion on the Website are solely their own).

6.7 You expressly acknowledge and agree that the Communication Facilities provide a means of public and not private communications.

6.8 THE GROVE GROUP HOLDINGS PTY LTD reserves the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone posting any materials within the Communication Facility which violate any applicable or relevant law.

SECTION 7 - LIABILITY AND INDEMNITY

7.1 To the fullest extent possible, the limitation of liability and indemnity set out in clause 8 of these terms also applies to use of the Site by replacing the word “Products” with “Site or the Comment Function”.

7.2 THE GROVE GROUP HOLDINGS PTY LTD may permit You to make, share, publish, post, store or upload information including data, text, video, still images, audio or other material on the Website (“Contributions”). You retain sole responsibility for and accept all liability for all Contributions You make to the Website.
THE GROVE GROUP HOLDINGS PTY LTD disclaims any and all liability in connection with Contributions. THE GROVE GROUP HOLDINGS PTY LTD assumes no responsibility for monitoring any Contributions, and does not endorse the information Contributions. THE GROVE GROUP HOLDINGS PTY LTD is under no obligation to treat Your Contribution as confidential. You expressly waive in favour of THE GROVE GROUP HOLDINGS PTY LTD and any other party authorised by THE GROVE GROUP HOLDINGS PTY LTD all moral rights and any similar rights in any jurisdiction which You may have or hereafter acquire in respect of any relevant communication or other material.

7.5 At the request and expense of THE GROVE GROUP HOLDINGS PTY LTD, You will execute and deliver to THE GROVE GROUP HOLDINGS PTY LTD such instruments and take such other actions as may be required to carry out this grant of licence and waiver.

SECTION 8 - YOUR ACCEPTANCE OF THIS AGREEMENTS AND CHANGES TO THIS AGREEMENT

8.1 You will be asked to accept this Agreement during the purchase process by ticking "I agree with THE GROVE GROUP HOLDINGS PTY LTD’s Terms and Conditions, Privacy Policy, Shipping Policy, Returns and Exchanges policy and site Disclaimer". By ticking this box You agree to the entirety of this Agreement.

8.2 To ensure that this Agreement is current, from time-to-time THE GROVE GROUP HOLDINGS PTY LTD will review this Agreement and reserves the right to change, modify, and add or remove portions of this Agreement at any time. You will be notified of any such changes here, by Email, or by means of a notice on our homepage or customer care area. This Agreement supersedes all prior Agreements. If You have commenced any transaction prior to a change to this Agreement, transaction will be effected in accordance with the terms in place at the time of the acceptance of Your purchase order as outlined in section: 1.3 of this Agreement.

SECTION 9 - WEBSITE CONTENT AND AVAILABILITY

9.1 In consideration of Your use of THE GROVE GROUP HOLDINGS PTY LTD Website, You agree to provide true, accurate, current and complete information about Yourself as prompted within the Website’s forms (such information being the "Registration Data”), and maintain and promptly update the Registration Data to keep it true, accurate, current and complete. In particular to register, You must provide Your real name and email address.

9.2 If You provide any information that is untrue, inaccurate, not current or incomplete, or THE GROVE GROUP HOLDINGS PTY LTD has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete. THE GROVE GROUP HOLDINGS PTY LTD do, however, reserve the right to cancel an order and/or reverse a payment if an order has been placed based on erroneous information.

9.8 Images displayed on this Website should be considered illustrative and informational only. We endeavour to display Products as close to the physical colour/appearance as possible. However, due to the nature of natural foods, colours can change from batch-to-batch and—as such—there may be a difference in appearance between online images and delivered product.

Depending on where you are and how soon you need your product determines which provider is used, how fast they peddle and any limitations surrounding that shipment.

2.2.1 Delivery of Products within Australia is via our shipping partners: Fastway Couriers, Couriers Please, DHL and Australia Post.
2.2.2 All Australia-wide shipments—with all shipping providers—must be signed for.
2.2.3 ‘Standard Service’ freight charges within Australia are at a flat rate of $8 for upto 450g, $13 for upto 2.5kg and $17 of 4.5kg. Unless otherwise stated.
Orders weighing more than 4.5kg are subject to the freight charges being calculated using a freight calculator to obtain the best price possible for You.
‘Standard Services’ are delivered between 2-7 business days from time of despatch, depending on location.
2.2.4 Delivery times vary depending on location.
Delivery speeds are based between metropolitan areas of major cities. Regional areas may take longer.
2.2.5 THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for delays caused that are outside our reasonable control, and we apologise for any inconvenience caused.
2.2.6 ‘Same Day’ deliveries are available in the Melbourne Metro area to specified postcodes.
Please see section 3 ‘Same Day Service’ of this statement for full details.
2.2.7 If the product is undeliverable, the postal company may attempt further delivery of the Product to You (please see section 2.3 and 2.4 of this Agreement for further details). However, if this is not effective, the product will be returned to THE GROVE GROUP HOLDINGS PTY LTD and a refund will be processed in accordance with the ‘Returns, Refunds and Exchanges Policy’.

2.3 Couriered Products:
Couriers cannot send packages to PO Box addresses, whether sent throughout Australia or Internationally. PO Box addresses can only be serviced using Australian Registered Post. If you prefer for your Product to be delivered using a secure courier service, please provide a physical postal address.
2.3.1 If the Product is delivered using a courier service, and you authorise an ATR (Authority to Leave) on the Purchase Order, then You accept full responsibility for packages being left by the courier, and any events that may occur due to this authorisation, including—but not limited to—a package being damaged, lost or stolen.
2.3.2 If the Product is delivered using the ‘Same Day’ service, and upon the first delivery attempt no-one is at the delivery address to receive the Product, and you haven’t authorised an ATR, then:

  1. The Product will be returned to THE GROVE GROUP HOLDINGS PTY LTD and a refund will be processed in accordance with the ‘Returns, Refunds and Exchanges Policy’, or, depending on the particular courier service. Or,
  2. You could be issued with a redelivery calling card, giving You up to 48 hours (2 business days) to call the courier service and arrange a redelivery to the same address. This 2nd redelivery attempt is at no additional charge, although, You must be home to sign for the package or leave a signed authorised ATR with instructions of where to leave the package. The package will be returned to THE GROVE GROUP HOLDINGS PTY LTD and a refund will be processed in accordance with the ‘Returns, Refunds and Exchanges Policy’, if:
    • The receiver is not home and an ATR is not authorised. Or,
    • If no call has been made to the courier service after the 48 hour period.

2.4 Australia Post Shipped Products:
2.4.1 If the Product is delivered using Australia Post, and the recipient is not present to receive the Product, it will be delivered to the closest Australia Post outlet and held as per their terms before being returned to THE GROVE GROUP HOLDINGS PTY LTD where a refund will be processed in accordance with the ‘Returns, Refunds and Exchanges Policy’.
2.4.2 In rural and regional areas of Australia, delivery times are in respect of delivery to the Australia Post Post Office of the principal township in that area. Delivery to final destinations may take longer. If in doubt please check with your local Australia Post Post Office.

SECTION 3 - SAME DAY DELIVERY SERVICE

We understand that sometimes you may want to obtain items quickly, maybe it’s a present for someone or you ran out of a particular product more quickly than anticipated. We have a ‘Same Day’ service that is currently available to customers who are close to our HQ in the Melbourne Metro Area. Check below to see if your postcode falls into the areas where we are currently able to offer the Same Day service.

3.1 ‘Same Day’ services are charged at a flat rate of $25 for a maximum of 4.5kg.
Orders weighing more than 4.5kg are subject to additional freight costs charges at $2.50 per kilo.

3.2 By choosing the ‘Same Day’ service, the delivery of your order will be as per one of the following 2 options:

  1. Order before 9am > Delivery is made in the afternoon of the same day.
  2. Order between 9am and 1pm > Depending on location, delivery is made either in the afternoon of the same day or the following morning.

3.3 If the Product is delivered using the ‘Same Day’ service, and upon the first delivery attempt no-one is at the delivery address to receive the Product, and you haven’t authorised an ATR, then:

  • The Product will be returned to THE GROVE GROUP HOLDINGS PTY LTD and a refund will be processed in accordance with the ‘Returns, Refunds and Exchanges Policy’. Or, depending on the particular courier service,
  • You will be issued with a redelivery calling card, giving You up to 48 hours (2 business days) to call the courier service and arrange a redelivery to the same address. This 2nd redelivery attempt is at no additional charge. However, You must be home to sign for the package or leave a signed authorised ATR with instructions of where to leave the package.

The package will be returned to THE GROVE GROUP HOLDINGS PTY LTD and a refund will be processed in accordance with the ‘Returns, Refunds and Exchanges Policy’, if:

  1. The receiver is not home and an ATR is not authorised. Or,
  2. If no call has been made to the courier service after the 48 hour period.

3.4 The ‘Same Day’ delivery service is currently available in the Melbourne area to the specified postcodes below:

SECTION 4 - TERMS

4.1 All items purchased from THE GROVE GROUP HOLDINGS PTY LTD are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to You upon THE GROVE GROUP HOLDINGS PTY LTD dispatching to the carrier.

4.2 Please do not enter both a street address and a PO box number, as this will delay the shipping of your package. If you enter a street address and a PO box number, THE GROVE GROUP HOLDINGS PTY LTD customer service team will need to contact you to confirm which address the package should be sent to. Your order will remain on hold until the shipping address is confirmed.

If we cannot get in touch with you within three days of the Purchase Order, the Purchase Order will be cancelled and refunded in accordance with the ‘Returns, Refunds and Exchanges Policy’.

4.3 Supplied Information:
You, the user, are responsible for providing correct and complete shipping information. Please ensure that the shipping information you have entered into the online form is correct and complete before submitting your Purchase Order.
4.3.1 THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for delayed or returned shipments as a result of incorrect or incomplete shipping information, failed delivery attempts, and/or unclaimed packages. (See below for further information).
4.3.2 If you have unintentionally submitted incorrect shipping information, please immediately contact our Customer Service team at admin@thegrove.life. THE GROVE GROUP HOLDINGS PTY LTD will make every effort to update the incorrect information prior to your products being shipped, however, we cannot guarantee that the information will be updated prior to shipping.
If your package is shipped using incorrect information that has been supplied and:

  • The package is lost—THE GROVE GROUP HOLDINGS PTY LTD are not responsible for replacing and/or re-shipping the package. Or,
  • The package is returned to our warehouse by the shipping provider—it is Your responsibility to pay any/and all additional charges incurred as a result of returning and/or resending the Product. (For full details please refer to section 4 of the ‘Returns, Refunds and Exchanges Policy’).

4.4 Damaged or Missing Orders:
4.4.1 THE GROVE GROUP HOLDINGS PTY LTD are NOT the shipping carrier and cannot be held responsible for goods that are either damaged in transit or not received. Damaged or lost orders should be resolved directly, with the company with whom the products traveled.
However, in good will, if the delivery carrier doesn't deliver your package or claims to have made the delivery but you have not received it, please inform THE GROVE GROUP HOLDINGS PTY LTD immediately and we will open an investigation with the carrier. After the investigation with the carrier and whether or not the order was insured, THE GROVE GROUP HOLDINGS PTY LTD may be able to reship a package.
4.4.2 THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for the outcome of this investigation.
It is Your responsibility to read the shipping options of the carrier before purchase to be informed about the options for insurance, including which carrier services offer automatic insurance and the terms of that insurance.
4.4.3 THE GROVE GROUP HOLDINGS PTY LTD do not insure packages that are shipped. Packages are not insured above and beyond the automatic insurance offered by certain carriers unless the insured option is chosen when your order is placed.

4.5 THE GROVE GROUP HOLDINGS PTY LTD Signature Packaging.
Full priced THE GROVE GROUP HOLDINGS PTY LTD Nourish Range purchases will be packaged in THE GROVE GROUP HOLDINGS PTY LTD signature shipment packaging. However, all INGREDIENT/SALE/DISCOUNTED/PROMOTIONAL items are simply packaged in a regular box with the item labeling.

RETURNS, REFUNDS, and EXCHANGES

INTRODUCTION

We at THE GROVE GROUP HOLDINGS PTY LTD make every effort to ensure that You receive the products and services You order. We rely on You to provide the correct information for us to be able to do this and meet Your expectations.
Deliveries are processed promptly in accordance of section 1 of the ‘Terms and Conditions’ and this ‘Shipping Policy Statement’.

SECTION 3 - RETURNED PRODUCTS?

3.1 THE GROVE GROUP HOLDINGS PTY LTD must be contacted prior to any returns, exchanges or refunds at: admin@thegrove.life. When THE GROVE GROUP HOLDINGS PTY LTD is not contacted prior to a return, exchange or refund, THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible:

  • For a prolonged or nullified refund due to a Product not being properly identified by THE GROVE GROUP HOLDINGS PTY LTD.
  • Where is has been sent to an address not associated with THE GROVE GROUP HOLDINGS PTY LTD. Or,
  • Where it has been lost or stolen during transit to THE GROVE GROUP HOLDINGS PTY LTD.

3.2 THE GROVE GROUP HOLDINGS PTY LTD will provide a refund / exchange (in accordance with this entire policy statement) of a Product purchased when the Product is returned to us within 14 days of purchase, unopened, unused, in the same state as originally sent and has not been tampered with in any way. (Less charges outlined in section 8 of this Agreement.)

3.3 A Product being returned MUST be in the same condition as it was passed to the courier by THE GROVE GROUP HOLDINGS PTY LTD. It must be properly packaged, protected and secured to avoid damage in transit.

3.4 All returned Product will be fully inspected upon arrival at THE GROVE GROUP HOLDINGS PTY LTD and prior to a refund being issued.

3.5 International returns:

International orders that incur customs / tax charges in the destination country and where the order is subsequently cancelled due to the refusal of acceptance of these charges, THE GROVE GROUP HOLDINGS PTY LTD will only refund the purchase order less any charges incurred by THE GROVE GROUP HOLDINGS PTY LTD. (See section 8 of this Agreement).

SECTION 4 - REFUNDING?

Sometimes errors occur during ordering. We understand, but also hope that you can appreciate that in providing you products and services, we incur costs.

4.1 THE GROVE GROUP HOLDINGS PTY LTD will provide a refund (in accordance with this Agreement) of a Product purchased when the Product is returned to us within 14 days of purchase, unopened, unused, in the same state as originally sent and has not been tampered with in any way. (Less charges outlined in section 8 of this statement).

4.2 Where the refund is requested or Product is received outside the 14 day period, refunds are made at the discretion of THE GROVE GROUP HOLDINGS PTY LTD and on a case-by-case basis.

4.3 THE GROVE GROUP HOLDINGS PTY LTD provides no refunds on items purchased after 28 days of Purchase Order—with no exceptions.

4.4 Duplicate Orders:

THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for duplicated orders.
Where an order is duplicated and THE GROVE GROUP HOLDINGS PTY LTD identifies the duplicate prior to it being shipped to you, we will contact You to determine the status of the order and process a refund. (Less charges outlined in section 8 of this Agreement).
Where the order is duplicated–unidentified by THE GROVE GROUP HOLDINGS PTY LTD–and shipped to You, we can refund the duplicate order if You wish to return the items. (Less charges outlined in section 8 of this statement).

4.5 Where products were unable to be delivered:

The goods will be returned to THE GROVE GROUP HOLDINGS PTY LTD, as per the ‘Shipping Policy’. When the returned parcel has been received, and checked it is unopened, unused, in the same state as originally sent and has not been tampered with in any way, THE GROVE GROUP HOLDINGS PTY LTD will provide a refund of received items. (Less charges outlined in section 8 of this Agreement).

4.7 Where products are opened, used or tampered with:

THE GROVE GROUP HOLDINGS PTY LTD is unable to refund products that have been opened, used or tampered with.

4.8 Any refund can only be made back to the credit card or Paypal account that was used to make the purchase from THE GROVE GROUP HOLDINGS PTY LTD. THE GROVE GROUP HOLDINGS PTY LTD will notify You when the refund has been processed. Any refund payments may take up to 7 business days to be received due to banking institution policies, and THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for these delays.

4.9 For further details surrounding items that cannot be refunded, please see section 6 and 7 of this Agreement.

SECTION 5 - EXCHANGING?

We understand that sometimes you accidentally order the wrong thing. More importantly we want to make sure that you purchase exactly what you need and are looking for to support you in achieving your goals.

5.1 THE GROVE GROUP HOLDINGS PTY LTD will provide an exchange for a product purchased when the product is returned within 14 days of purchase, unopened, unused, in the same state as originally sent and has not been tampered with in any way. (Less charges outlined in section 8 of this Agreement).

5.2 Where the FULL PRICED product is being exchanged for a product of a greater value, you will be notified of any additional payment required by You to complete the exchange in addition to any charges. (Outlined in section 8 of this Agreement).

5.3 Where the FULL PRICED product being returned and exchanged is of greater value than the product it is being exchanged for, THE GROVE GROUP HOLDINGS PTY LTD will refund the difference. (Less charges outlined in section 8 of this Agreement).

5.4 THE GROVE GROUP HOLDINGS PTY LTD are only able to exchange FULL PRICED items if the intended exchange item is available.

If the stock is not available, a credit note or refund will be offered as an alternative.

5.6 In the event that a refund is required during the exchange process, it shall be made to the credit card or Paypal account that was used to purchase THE GROVE GROUP HOLDINGS PTY LTD product. Any refund payments may take up to 7 business days to be received due to banking institution policies, and THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for these delays as they are out of our control.

5.7 THE GROVE GROUP HOLDINGS PTY LTD offers a single refund per customer on return freight for exchanges. Postage refunds only apply for FULL PRICED items intended for exchange. You must include the receipt of the freight to be eligible for a refund.

5.8 For further details surrounding items that cannot be exchanged, please see section 6 and 7 of this Agreement.

SECTION 6 - SALE / PROMOTIONAL / DISCOUNTED PURCHASES?

6.1 Unfortunately, with no exception, can THE GROVE GROUP HOLDINGS PTY LTD offer returns, exchanges or refunds on items purchased on sale, that have been discounted or that have been purchased via a promotion / promotional code.

6.2 These items may be on sale, promotion or discounted due to various reasons such as those surrounding perishable goods. Please ensure that you read the terms and conditions of the sale, promotion or discount to ensure that the product meets your expectations prior to submitting the Purchase Order.

6.3 This applies to both Australian and International orders.

SECTION 7 - NON-REFUNDABLE / EXCHANGEABLE PURCHASES?

There are a number of products that THE GROVE GROUP HOLDINGS PTY LTD cannot accept for return, exchange or refund:

  • Sales, promotional and discounted items.
  • Where the refund is requested or Product is received outside the 14 day period, refunds are made at the discretion of THE GROVE GROUP HOLDINGS PTY LTD and on a case-by-case basis.
  • THE GROVE GROUP HOLDINGS PTY LTD provides no refunds on items purchased after 28 days of Purchase Order—with no exceptions.
  • THE GROVE GROUP HOLDINGS PTY LTD is unable to refund any ebook product purchase.
  • THE GROVE GROUP HOLDINGS PTY LTD is unable to refund, exchange or accept returns of any consumable Product purchased where the Product has been opened, the seal is broken, has been used, is not in the same state as originally sent or has been tampered with in any way. Extreme cases may be heard at the discretion of THE GROVE GROUP HOLDINGS PTY LTD.
  • Probiotics cannot be returned as they are highly perishable and require specific storage solutions. As THE GROVE GROUP HOLDINGS PTY LTD is unable to control the nature of the storage once it is received by You, it cannot be held responsible for a return, refund or exchange of this product.
  • THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for, and do not refund goods that are either damaged in transit or not received. Please see the ‘Shipping Policy’ for more information.
  • THE GROVE GROUP HOLDINGS PTY LTD cannot be held responsible for, and do not refund or exchange goods that are lost, stolen, misrouted, undelivered or those seized by customs (either during sending to You or You sending back to THE GROVE GROUP HOLDINGS PTY LTD).

SECTION 8 - COSTS INCURRED FOR RETURNS / REFUNDS / EXCHANGES?

8.1 Charges incurred for refunds:

All THE GROVE GROUP HOLDINGS PTY LTD refunds, unless otherwise informed in writing, incur:

  • A 3% processing and handling fee of Purchase Order total value. These fees are merely those fees that THE GROVE GROUP HOLDINGS PTY LTD incurs from third parties to process and handle your transaction.
  • The cost of any postage / freight incurred on the Purchase Order.

8.2 Return freight costs:

You, the returner are liable for freight costs to return the goods to be returned to, refunded or exchanged by THE GROVE GROUP HOLDINGS PTY LTD. THE GROVE GROUP HOLDINGS PTY LTD cannot be held liable for any items lost in transit.

8.3 We will waiver the additional freight cost (Australia-wide) for all FULL PRICED product being returned and exchanged for a FULL PRICED product of a value greater or the same as the returned FULL PRICED product.
This waiver is only applicable once, on the first exchange, and as stated to FULL PRICED products only. Subsequent freight costs associated with exchanges will not be refunded/paid by THE GROVE GROUP HOLDINGS PTY LTD.
We are unable to offer this waiver to international customers at this time. We apologise for any inconvenience caused.
